Terms of Service

By accessing or using CommentCart, you agree to these Terms of Service. If you do not agree to these terms, you should not use the platform.

CommentCart is a software platform that enables independent merchants to connect with customers and process sales through seller-owned storefronts, payment flows, communication tools, and social media automation features.

CommentCart is not the seller, merchant of record, importer, shipper, or fulfiller of products sold by merchants using the platform.

All product fulfillment, refunds, returns, warranties, shipping, delivery issues, taxes, regulatory compliance, and customer support are the sole responsibility of the merchant.

Vendor Responsibilities

Vendors are solely responsible for fulfillment, shipping, refunds, chargebacks or disputes, customer support, product claims, product legality, and all applicable legal and regulatory compliance for the products they sell.

Vendors are also solely responsible for complying with all applicable tax laws, including the calculation, collection, reporting, filing, and remittance of sales taxes, VAT, GST, or other transaction-based taxes in any jurisdiction where they have tax obligations.

CommentCart does not act as the merchant of record and does not assume responsibility for vendor tax compliance, tax filings, or tax remittance.

Vendors are responsible for the content, configuration, keywords, messages, links, replies, products, offers, and other automation settings they create, configure, or enable through CommentCart.

Third-Party Platforms

CommentCart integrates with third-party platforms and services, including Meta, Facebook, Instagram, WhatsApp, payment providers, and other services that may be supported from time to time. These third-party platforms are independently operated and are not controlled by CommentCart.

Use of third-party platforms through CommentCart remains subject to the applicable third party's own terms, policies, rules, technical limitations, messaging requirements, API requirements, and enforcement decisions.

Vendors are responsible for ensuring that their use of CommentCart and their connected accounts complies with all applicable third-party platform terms and policies.

CommentCart does not guarantee the continued availability, functionality, permissions, API access, messaging capabilities, integrations, or features provided by any third-party platform. Third-party platforms may modify, restrict, discontinue, suspend, or revoke features, permissions, API access, accounts, pages, profiles, messaging capabilities, or other functionality at any time.

Social Media Account Restrictions and Suspensions

CommentCart provides tools that allow vendors to automate certain interactions through supported social media platforms. CommentCart does not control the moderation systems, automated enforcement systems, account reviews, rate limits, algorithms, policies, or enforcement decisions of Meta, Facebook, Instagram, WhatsApp, or any other third-party platform.

Accordingly, CommentCart cannot guarantee that use of the service will prevent a vendor's social media account, page, profile, messaging capability, API access, reach, or other platform functionality from being limited, restricted, suspended, disabled, terminated, or otherwise affected by a third-party platform.

To the maximum extent permitted by applicable law, CommentCart is not responsible for restrictions, suspensions, disabled or terminated accounts, loss of platform access, reduced reach, messaging restrictions, API restrictions, or other enforcement actions imposed by a third-party platform.

Vendors remain responsible for their social media accounts, content, automation configuration, messaging practices, and compliance with applicable third-party platform policies.

CommentCart may throttle, delay, pause, limit, or disable automation functionality when reasonably necessary to maintain platform stability, comply with third-party requirements, respond to rate limits, prevent abusive or potentially harmful activity, or reduce the risk of platform or account restrictions.

No Guarantee of Results

CommentCart does not guarantee any particular level of engagement, followers, leads, sales, revenue, conversions, response rates, account growth, social media reach, or other business results.

Results may vary based on factors outside CommentCart's control, including customer behavior, vendor content, social media algorithms, third-party platform policies, account status, market conditions, and vendor configuration.

Service Availability

CommentCart does not guarantee that the service will be uninterrupted, continuously available, secure, or error-free.

The service may experience interruptions, delays, failures, or reduced functionality due to maintenance, software errors, infrastructure failures, internet disruptions, third-party outages, API changes, rate limits, platform restrictions, security events, or circumstances outside CommentCart's reasonable control.

CommentCart may modify, suspend, discontinue, or limit portions of the service when reasonably necessary for security, compliance, maintenance, technical, operational, or third-party platform reasons.

Buyer Notice

Purchases made through CommentCart are fulfilled directly by the seller. CommentCart provides checkout, storefront, communication, and automation technology only and is not responsible for seller performance, shipping delays, non-response from sellers, returns, refunds, tax handling, product disputes, or post-purchase disputes.

Disclaimer of Warranties

To the maximum extent permitted by applicable law, CommentCart is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise.

CommentCart does not warrant that the service will always be available, uninterrupted, error-free, compatible with every third-party platform, or that use of the service will produce any particular business, marketing, sales, or social media result.

Limitation of Liability

To the maximum extent permitted by applicable law, CommentCart and its owners, affiliates, officers, employees, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to the use of, inability to use, or reliance on CommentCart.

This includes, without limitation, loss of profits, revenue, sales, business opportunities, customers, data, goodwill, reputation, social media reach, messages, followers, advertising expenditure, or access to third-party accounts, pages, profiles, APIs, or services, even if CommentCart has been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, CommentCart's total aggregate liability arising out of or relating to the service or these Terms will not exceed the total amount paid by the applicable customer to CommentCart during the six (6) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, these exclusions and limitations will apply only to the maximum extent permitted by applicable law.

Indemnification

To the maximum extent permitted by applicable law, vendors agree to indemnify, defend, and hold harmless CommentCart and its owners, affiliates, officers, employees, contractors, and service providers from claims, liabilities, damages, losses, costs, and reasonable legal fees arising out of or relating to the vendor's products, content, communications, automation configuration, violation of law, violation of third-party rights, violation of third-party platform policies, or misuse of the CommentCart service.

Limitation of Platform Responsibility

By using the platform, buyers and sellers acknowledge that CommentCart provides technology that facilitates transactions, communications, and automation between independent sellers, buyers, and third-party platforms.

CommentCart is not responsible for the condition, quality, safety, legality, delivery, taxation, fulfillment, accuracy, or suitability of products listed or sold by vendors.

Changes to These Terms

CommentCart may update these Terms from time to time to reflect changes to the service, applicable laws, third-party platform requirements, or business practices. Continued use of CommentCart after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
